Implementation
The implementation step will go a long way to help ensure the success of the partnership. This step should include an independent review of the various calculations in the previous steps. Section 2.08 discusses public relations issues -- it will provide information on working with local politicians that will be useful at any phase of the partnership project.
The local governing body may have specific requirements for notification and approval. In that case a summary of the partnership should be prepared to expedite the notification and approval process. The summary should contain the following information:
- The full identity of the successful contractor, to include:
- corporate structure,
- cross-ownership of associated companies, and
- details of internal subcontracts.
- The duration of the contract
- Details of future transfer of assets to the government at no or minimal cost, including
- details concerning the right to receive the asset, and
- date of the proposed future transfer.
- Identification and timing of any public assets to be transferred to the contractor.
- The price to be paid by the public, including
- the basis for future changes in the price.
- Maintenance provisions.
- Renegotiation provisions.
- Results of cost benefit analysis.
- Significant guarantees (to include loans etc.) that are part of the partnership.
- Any key elements of the contract not covered above.
In providing this information, the government must be cognizant of publishing information that would impact the firm's cost structure or profit margins, proprietary intellectual property (including trade secrets), and other matters that could potentially damage the contracting firm commercially or place it at a competitive disadvantage.
